iSAM Terms and Conditions of service
Our terms are simple practical measures to ensure we can offer you a smooth and reliable service.
A. Definitions
“Customer”, “you”, “your” means you, the person or persons in whose name(s) a service is maintained by Abazander.
“Service” means any service Abazander offers, including but not limited to Abazander Open CRM.
B. Termination of Service and Warranty
Abazander reserves the right to block access to or terminate any service at any time, at our discretion. Whilst we have no intention of ever blocking access to a service, this may become necessary if payment is not received in a timely manner, or our Acceptable Use Policy is breached.
Abazander explicitly offers no warranty for any service, or guarantee that it is fit for a particular purpose. Whilst we offer no warranty, we do absolutely everything in our power to keep the service operating correctly and reliably. We will notify our customers of any scheduled maintenance in advance by email, and we will endeavour to keep down time for customers' services to an absolute minimum.
Abazander reserves the right to vary these terms and conditions without notice. However we will make every endeavour to give 30 days notice in the event of a change.
C. Payment and Cancellation
Payment will be expected by the due date shown on the invoice, unless otherwise agreed by Us in writing in advance.
If the customer has agreed to pay by credit card, we will attempt to debit the card any time on or after the date payment is due.
If no payment is received by the date it is due, we will contact the customer in writing by email to request immediate payment.
If payment has not been received 14 days after the date it was due, we will contact the customer in writing by post to request immediate payment.
If payment has still not been received 21 days after the date the payment was due, we will, at our discretion, block access to all services to which the customer has a subscription.
It is the customer's responsibility to maintain current contact and payment details.
Abazander can be contacted by E-mail, post and telephone, in that order of preference.
Abazander iSAM fees are payable monthly in arrears with a minimum term of six months
Excess Bandwidth and Storage will be charged automatically without notice, as measured by our systems. Our measurements are available on request.
The customer is responsible for monitoring and controlling bandwidth (e.g ensuring that large attachements i.e > 500kb are not sent to multiple email contacts, or that documents do not exceed 5Mb)
Each user account has a 1Gb data cache limit, additional data cache space is billed at £1.99 per Gb
Payment terms for any other service or product will be agreed in writing before purchase.
All fees paid for are non-refundable, except in rare disputes where we may agree to refund unused fees on a pro-rata basis.
Services can be cancelled at any time, subject to minimum terms and unless otherwise specified.
D. Acceptable Use Policy (AUP)
The customer may not use, or permit use of any service for any purposes which contravenes the laws of the United Kingdom.
The customer may not offer for download, either publicly or privately, any of the following types of content through any service:
- Pornography;
- Warez (i.e. illegally copied software);
- Copyrighted content in any format, including but not limited to media files (MP3s, WAVs, WMVs, MOVs etc.), for which the customer does not own the copyright or does not have the copyright holder's permission.
- The customer may not use, or permit use of any service for network abuse: the bulk sending of any kind of unsolicited network traffic, including but not limited to email, ICQ/AIM/MSN messages or newsgroup postings. See our advice regarding spam email
- The customer is entirely responsible for any activity conducted on any service, and must take steps to ensure that anyone to whom access is granted will not breach this AUP in turn.
- The customer agrees by subscribing to a service that the customer will fully indemnify us against any claims for loss or damage by any third party in respect of activities conducted on any service under the customer's control.
E. Business Continuity
In the event that Abazander Ltd cease trading, we have the following policy in place to protect our clients- All our infrastructure is paid pro-forma ensuring a minimum of 3 months service continuation to our clients.
- Upon instruction to cease trading, a copy of each clients iSAM software instance will be copied to disc and shipped to their companies Head Office address, along with the last 3 backups of their database.
- Coupled with this our clients will also be provided with a Server system installation disc, which will enable them or an appointed computer technician to build an iSAM server, upon which they can install their copy of the iSAM system software, and their database.
F. Product deliverables
This section details the deliverables included in your version of the iSAM system.
iSAM Lite
iSAM Lite is delivered “as is” and subject to user number and data limitations. These limitations can change from time to time but are clearly outlined on our website in the ‘Our Services’ section. Existing iSAM Lite users will be notified of any such changes that may affect them with 30 days notice.
iSAM
iSAM is delivered “as is” and has no user or data limits.
iSAM Pro
Includes two hours of pre-set up business analysis via our online conference facilities.
We will analyse your business processes in preparation for drafting a project scope document for your consideration and confirmation. This analysis enables us to identify system requirements specific to your business and to modify the base system by creating additional fields, customising labels and activating/deactivating modules as well as setting up certain automated business processes as long as these do not require custom development. Custom development is usually required for highly bespoke functionality, e.g. integration with other existing software packages such as Sage or SAP etc. The requirement for bespoke development work is identified during the initial business process analysis and will be quoted for in the project scope document if required.
Once the project scope has been agreed on and implementation has commenced, further subsequent changes to the implementation are charged separately at our current rates.
iSAM Pro7
iSAM Pro7 – as iSAM Pro, but with additional time for the creative development process to identify and develop the design template for your iSAM powered website. This design process includes a two hour on-site meeting to discuss design concepts, followed by the creation of three visuals for the site. From these three visuals you will choose one and can also provide one set of amends. With the design work in place, we then build the site framework which can include up to three navigation menus with up to 15 navigation entries, each linked to either a fixed page, set of pages, or a section of multiple pages. In each navigation case we will provide one base page (article) populated with Lorum Ipsum.
Training & Support
For iSAM Lite and iSAM users support is via our website and community forum.
Support for iSAM Pro and Pro7 is accessible from within the application or via our website. In addition, our knowledge base and community forum are also freely available for use.
We also provide access to our online training library which is a full curriculum of training for every module within iSAM, and specific courses for the Website Content Management system. These videos and supporting materials each equate to an hour of curriculum providing a full 16 hours of training.
